Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you, your organization, and Artificial Intelligence Control Standard (AICS) LLC regarding the use of AICS Governance or FinOps for AI assessments, client reports, and client portal services.

2. Services Overview

AICS provides separately scoped AI Governance and FinOps for AI assessments and external-certification readiness support. Services may include:

• Governance evidence review, readiness evaluation, and executive reporting
• FinOps for AI evidence review and a separate client-facing report
• Prioritized findings and remediation recommendations
• Optional follow-up reviews or reassessments, separately agreed
• External-certification readiness support
• Client portal access for evidence submission and workflow visibility

3. Eligibility & Account Registration

To use AICS services, you must be authorized to act on behalf of the organization requesting Governance or FinOps assessment or external-certification readiness support services.

• You must be at least 18 years old.
• You must have authority to submit information on behalf of your organization.
• You agree to provide accurate and current information during intake, onboarding, and portal use.

4. Assessment Process

The assessment process may include request intake, scope review, evidence submission, document review, human review, and executive reporting. Governance and FinOps for AI are separately scoped and reported.

• Submit an assessment request.
• Agree the scope, services, fees, timeline, and responsibilities in written engagement terms.
• After acceptance, provide requested documentation through the client portal.
• Participate in review or clarification activities where required.
• Receive the agreed assessment findings, priorities, and recommendations.

Submitting a request does not create an active engagement. Follow-up reviews and reassessments are optional unless expressly agreed in the applicable engagement terms.

5. Fees & Payment

Fees are based on the applicable service package, assessed scope, organization size, assessment requirements, and any optional follow-up review or reassessment work agreed.

• Startup Package: $5,000
• Enterprise Package: $15,000
• Re-Assessment: $2,500–$7,500
• Optional Governance Follow-Up Review: $2,000/review

FinOps for AI assessment scope and fees are confirmed separately in the applicable written engagement terms.

Payment terms may be defined in a proposal, invoice, statement of work, or other written agreement between AICS and the client organization.

6. Assessment Scope and Follow-Up

Assessment findings reflect the information and evidence reviewed for the agreed scope and reporting period. They are a point-in-time review and do not imply continuous monitoring of the organization.

• Material changes to AI systems, ownership, governance practices, or evidence may affect earlier findings.
• Clients may request a follow-up review or reassessment when needed.
• Additional work, scope, timing, and fees must be agreed before it begins.
• An initial assessment does not automatically enroll a client in recurring reviews or renewals.

The applicable written engagement agreement defines the duration and responsibilities for the services selected.

7. Use of Assessment Reports

Clients may use the delivered report for the purposes defined in their engagement. References to AICS findings must accurately identify the assessed organization, scope, and reporting period.

• Reports must not be altered or presented in a misleading way.
• AICS reports do not imply endorsement of products, services, systems, or business activities.
• Reports must not be presented as accredited certification, ISO/IEC certification, regulatory approval, or a legal determination of compliance.
• Use of AICS branding requires authorization.

8. Service Access and Misuse

AICS may restrict access to services for materially false or misleading submissions, unauthorized access, misuse of assessment reports, or nonpayment of agreed fees, subject to the applicable written engagement terms.

Where appropriate, AICS will provide notice describing the issue and an opportunity to resolve it. Serious misuse or unauthorized access may require immediate restriction of service access.

9. Confidentiality

Assessment reports, submitted evidence, uploaded customer materials, confidential organizational information, and other non-public assessment materials are treated as confidential engagement-related information unless disclosure is authorized or required by law.

10. Liability Limitations

AICS services are provided for Governance Assessment, FinOps for AI assessment, governance review, client reporting, and external-certification readiness support. AICS assessment reports are not accredited certification, ISO/IEC certification, regulatory approval, a legal determination of compliance, a guarantee of external certification, or a substitute for a determination by an accredited external certification body. AICS does not guarantee satisfaction of every legal or regulatory obligation, regulatory approval, business outcomes, risk elimination, legal compliance, security outcomes, or external certification.

Services are provided “as is” to the fullest extent permitted by applicable law, without warranties not expressly stated in a written agreement.

11. Governing Law

These terms are governed by the laws of Minnesota, United States, unless a separate written agreement states otherwise.
